On March 4, 2008, the Court approved the proposed settlement and
granted an allowance of attorneys fees and expenses.
On April 2, 2008, a Notice of Appeal was filed by Attorneys Rex A.
Sharp and Barbara C. Frankland, of the law firm of Gunderson, Sharp
& Walke, L.L.P., on behalf of Wallace B. Roderick Revocable Living
Trust. On January 22, 2009, the Kansas Supreme Court dismissed
the appeal. Under the settlement agreement, OXY made the
deposit of settlement funds on February 5, 2009. One of the
plaintiffs' Class Counsel, Fleeson, Gooing, Coulson & Kitch, L.L.C.,
mailed distribution checks to the Plaintiff Class on February 6,
2009. Plaintiffs' counsel has
prepared a Final Payment Schedule (click
here to view) showing amounts distributed to the Plaintiff
Class.
