Fleeson Gooing, together with co-counsel from Colorado, recently obtained a judgment of in excess of $5 million in a class action lawsuit against WPX Energy in Garfield County, Colorado.

The suit claimed that WPX had wrongfully deducted certain amounts from royalty payments to landowners with whom it had entered into oil and gas leases. A portion of the case was settled in 2009, with WPX (then known as Williams Companies) agreeing to pay about $4.7 million at that time. Other aspects of the case continued to trial, with the plaintiff class ultimately being awarded an additional $5.02 million in damages and interest. An appeal by WPX is anticipated.

Dave Seely, Tom Kitch, Greg Stucky, and Dan Lawrence were the Fleeson Gooing attorneys involved in the successful prosecution of the case.
